Another quality plow jockey

    The Orchard Park resident who hired a local service station owner to plow his driveway never got the job done Saturday.

    That’s because the plow operator, Fred Darstein, 51, was arrested just before 5 a.m. Saturday when town police found him along Ellicott Road out of gas and with an open container. It all resulted in a slew of charges. Police said it was the sixth alcohol-related offense for the Orchard Park resident.

    “According to my lieutenant, the vehicle was on the shoulder of the road and this individual had no gas left,” said Orchard Park Police Chief Mark F. Pacholec, who added that his officer then ran a field sobriety test, which Darstein failed.

    The officer also determined that Darstein’s license was revoked as a result of driving while intoxicated convictions. He was charged with felony DWI (because of the previous convictions), felony aggravated unlicensed operation, DWI, aggravated unlicensed operation, operating a vehicle without an ignition interlock, and possession of an open alcoholic beverage in the vehicle.

    He refused to take a breath test, police said, and was being held for arraignment in Orchard Park Town Court late Saturday.

    Pacholec said town police have been aware of Darstein because of his previous alcohol-related arrests.

    “There’s a problem there,” he said.

    So break this down, he owns a gas station but runs out of gas, Next he's sitting in the truck which is not running ,don't know if he was waiting for someone. But its been close to zero every night with wind chills around -20.

    Unfortunately this just helps solidify some of the ideas that this industry is full of alcoholic, drug addicts, and criminals.

    I'm sure he only refused the breath test until he could finish plowing and technically he wasn't driving. He was probably just guarding the truck until the operator came back with gas.
