Just because people do it doesn't mean it's legit. Your truck under your direction, doing your route engaging in your primary business with you paying all expenses is an employee.

spend a few minutes and educate your self on what happens if the IRS catches you or if the employee decides he doesn't want to pay his taxes and claims he was an employee. Im just trying to save you some hassle

Plenty of folks do it, but from the stories you hear about companies that get caught and put out of business because they can't pay all of the back taxes the IRS thinks you owe them makes it so not worth the risk in my opinion.

I usually pay a guy up to $600 like you can legally to try him out so to speak.
After that hes is on the books and workers comp.

Yup, up to a certain amount and they do not have to be on the books. $500 is what I think it is. After that, they have to be a legal employee.

If he is using your truck and coming in when you tell him. He is YOUR employee.

This were my idea would work. Go to a temp agency and tell them to hire your guy. Then set it up for him to plow for you ,then turn in the hours and they pay out all the taxes and bill you.

Not on the edge. In your truck - Employee. I am curious as to why in an industry that is time sensitive, whose owners and employees are really on call 24/7 during the entire winter season and whose service the public apparently needs and or desires, are so many in our industry trying to get around the cost of doing business?
