Darryl has it. Maybe make them 2 different items. Consider making number 5 something to the effect of:

ABC Plowing shall have the final authority to provide services without additional notification if during site checks ABC Plowing observes hazardous conditions, but minimum service accumulation has not been otherwise been reached. ABC Plowing make no guarantee of slip free surface and ABC Plowing shall be the sole determiner of when site checks are warranted. In the even that hazardous conditions form after snow events have ended, client must inform ABC Plowing immediately. Rates for partial services are as follows, unless otherwise and specifically detailed in this agreement. Partial Plowing or Parking Space Cleanup $$$, Spot Salt Application $$$ per X lbs.

There are about 30 other things you should add, but this is why your best bet is to hire a contract lawyer to draft you up a contract.

I can't say that is ideal because the contractor should have the final say in what and when to service. Triggers of any depth are the base of the issue. The problem is that conditions exist but the agreement rejects service. A good contract surely has a service by others clause and if not seasonal than a reimbursement for site checks. When I talk about site checks though I'm talking about parked cars, refreeze, and final cleanup, or spot accumulation. I'm not talking about measuring 2" with a 3" trigger, that is insane, and personally I reject anything other than no minimum and we have final authority.

I actually don't do contracts at all for plowing services under advice from both my attorney and insurance underwriter. All I provide is my billing and payment terms on the bottom of my invoices. Granted, my accounts are mostly residential with one factory lot. I know a lot of you don't have a choice in the matter.
